General Data Protection Regulation (GDPR)

The General Data Protection Regulation (GDPR) is designed to allow individuals to exercise more control over their personal data. Since 25 May 2018, Enterprise Ireland has been obliged to comply with the provisions of the GDPR, which replaces the EU Data Protection Directive.

Individual rights under the General Data Protection Regulation

The following rights of data subjects arise from the General Data Protection Regulation:

  1. the right to information
  2. the right to rectification
  3. the right to erasure
  4. the right to restriction of processing
  5. the right to data portability
  6. the right to object
  7. Rights related to automated decision-making and profiling

Definition of „personal data“

The term „personal data“ includes any information relating to a living, identified or identifiable person (such an individual is referred to as a „data subject“).

A person is identifiable if he or she can be identified, directly or indirectly, by means of an „identifier“. The GDPR lists some examples of identifiers, including names, identification numbers, images, or location data. A person may also be identifiable by being associated with traits that are specific to their identity, such as physical, genetic, or cultural traits.

How to submit a GDPR data request to Enterprise Ireland

You can send a request for information about data by post or e-mail to the following person:

Your request should include the following information:

  • A note that the request is based on the General Data Protection Regulation
  • possibly a lot of information about what the content of the request for information is
  • the form in which you wish to receive the records (e.g. photocopies or in electronic format)

Proof of identity is required to process the request for information, e.g. Your driver’s license or identity card. Please note that depending on the nature of the request, additional proof of identity may be required. Enterprise Ireland’s Data Protection Officer will, where necessary, review the requirement to provide further proof of identity before processing your request.

Duration of processing a request for information about data

The receipt of your request for access to data will be confirmed within five working days. Your request will be answered no later than one month after receipt of the same. It is possible that the time frame of one month will be extended by two more months if necessary. This depends on how complex the request is and how high the number of requests is. In such a case, Enterprise Ireland will notify you of any extension and the reasons for the delay within one month of receipt of the request.

If Enterprise Ireland fails to take action as a result of your request, our company must notify you immediately and no later than one month after receipt of your request:

  • the reasons for inaction
  • Your right to lodge a complaint with the supervisory authority and to appeal.

 

Costs associated with a request for access to data

No fees will be charged for processing your request. In cases where a data subject’s requests are considered manifestly unfounded or disproportionate (for example, where an individual repeats requests unnecessarily or where it is too difficult to select a particular person from the database), Enterprise Ireland may

  1. charge a reasonable fee based on the administrative costs of obtaining information or taking action; or
  2. refuse to act on your request.
